Terms of Service

1. Overview

Welcome to resumAI ("we", "our", or "us"). These Terms of Service ("Terms") govern your access to and use of our resume parsing and AI-driven extraction platform, available at www.resumai.eu (the "Platform").

By using the Platform, you agree to be bound by these Terms. If you do not agree, you may not use our services.

Please also review our Privacy Policy to understand how we handle your data.

2. Use of the Service

a) Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement. You are solely responsible for ensuring that any data you upload complies with applicable data protection laws, including the General Data Protection Regulation (GDPR).

b) Account Usage

Each account is linked to a single email address. While we do not explicitly forbid account sharing, we reserve the right to monitor usage and enforce fair use policies.

c) Data Responsibility

By uploading resumes or CVs, you confirm that you have lawful authority to process the personal data they contain. resumAI does not verify or moderate document contents.

3. Subscription Plans and Free Trial

a) Free Trial

New users may activate a free trial account valid for up to 30 days, with a credit balance equal to 50% of the basic tier's monthly credit allowance.

If no purchase is made within that 30-day period, the account becomes inactive and is subject to resumAI's data retention policy (see Section 6).

b) Paid Plans

We offer monthly subscriptions with varying features based on plan tier, including document upload limits, processing capacity, and access to advanced tools.

c) Refund Policy

Refunds apply only to the current billing month and only if no documents were uploaded or exported:

• 100% refund within 5 days of payment
• 50% refund within 15 days
• No refunds are issued after 15 days

4. Acceptable Use

You agree not to:

• Upload or process illegal, offensive, or harmful content
• Use the Platform to violate privacy or data protection laws
• Attempt to interfere with the Platform or gain unauthorized access

We do not actively moderate user content but may investigate abuse reports.

5. Custom Queries and AI Processing

Only users on eligible plans may create and execute custom queries.

AI processing is performed exclusively through predefined query mechanisms. Users do not interact directly with AI models. Query outputs are derived from the structured data extracted from uploaded resumes.

6. Data Retention, Inactivity, and Deletion

• Uploaded resumes are retained for up to 12 months for quality assurance purposes
• Users can initiate deletion at any time using the purge function. Purged data is soft-deleted for 30 days before permanent removal
• During the soft-deletion period, users or data can be recovered upon request by emailing support@resumai.eu, provided sufficient identifying information is given
• Credit balances are not recoverable once an account has entered the soft-deleted state
• Accounts with no purchase in the last 90 days (excluding enterprise plans) will be marked inactive
• Inactive accounts are soft-deleted after 3 months of inactivity

7. Intellectual Property

All branding, platform code, and content (excluding uploaded resumes) are the property of resumAI or its licensors.

You retain ownership of your uploaded data but grant us a limited license to process it solely to provide the service.

8. Service Availability and Changes

We strive to maintain continuous service but do not guarantee uninterrupted access or uptime.

We reserve the right to modify, suspend, or discontinue any part of the Platform at our discretion, with or without prior notice.

9. Termination

We may suspend or terminate your account for:

• Violation of these Terms
• Abuse, unauthorized use, or harmful activity
• Inactivity for more than 3 months, following notice

You may delete your account at any time via your user profile.

10. Disclaimers and Limitation of Liability

resumAI is provided "as is" without warranties of any kind.

We are not liable for:

• Any loss of data, revenue, or business due to downtime or service issues
• Unauthorized use or disclosure of data caused by users or third parties

11. Governing Law

These Terms are governed by the laws of Portugal. Any disputes shall be subject to the exclusive jurisdiction of the courts of Lisbon, Portugal.
